1. Scope of Application

  1. These Terms and Conditions apply to all contracts for the rental of holiday apartments/accommodations (“Accommodation”) as well as to all related services provided by the Host.
  2. Deviating terms and conditions of the Guest shall only apply if expressly agreed in writing by the Host.

2. Contracting Parties and Conclusion of Contract

  1. The contracting parties are the Host (see above) and the booking Guest.
  2. The accommodation contract is concluded once the Guest makes a binding booking and the Host accepts it. Acceptance usually takes place via booking confirmation in text form (e.g. by email).
  3. By booking, the Guest confirms that they have taken note of these T&C and any supplementary rules (e.g. house rules).

3. Services, Prices, Payment, Set-off

  1. The Host provides the booked accommodation during the agreed period and performs the agreed additional services.
  2. The Guest undertakes to pay the agreed price including any incidental costs (e.g. final cleaning, tourist tax). Unless otherwise stated, all prices include applicable statutory taxes.
  3. The Host may require a deposit, advance payment, and/or a security deposit. Amounts and due dates are specified during the booking process and/or in the booking confirmation.
  4. In case of payment default, statutory provisions apply. After expiry of a reasonable grace period, the Host may withdraw from the contract and/or claim damages.
  5. The Guest may only set off claims or exercise rights of retention if such claims are undisputed or legally established.

4. Cancellation/Withdrawal by the Guest

  1. Free cancellation is only possible if expressly offered (e.g. up to a certain date in the booking process).
  2. After expiry of a free cancellation period or in case of no-show, the agreed price is payable minus saved expenses and minus revenues from any re-letting.
  3. The Guest may prove that no or significantly fewer expenses were saved.

5. Withdrawal or Termination by the Host

  1. The Host may withdraw from the contract before arrival if double booking occurs, if the Guest is in payment default, or if there are other reasonable grounds making performance unfeasible before arrival.
  2. The Host may withdraw or terminate the contract if force majeure or other circumstances beyond the Host’s control substantially impede, endanger, or make performance impossible.
  3. The Host is further entitled to withdraw from or terminate the contract without notice if:
    • rooms/accommodations were booked under misleading or false information or by concealing essential facts (such as the Guest’s identity, payment ability, or purpose of stay),
    • the accommodation is misused (e.g. unauthorized commercial use, illegal activities, admission of unregistered persons),
    • the house rules are seriously violated (e.g. smoking in non-smoking areas, severe pollution, intentional damage, non-compliance with quiet hours),
    • domestic peace is persistently disturbed or other persons are endangered, insulted, threatened, or harassed,
    • the Guest’s behavior seriously endangers the safety or reputation of the accommodation,
    • due payments remain outstanding despite reminder.
  4. In the event of justified withdrawal or termination by the Host, the Guest has no claim to damages. Payments already made may be retained after deduction of saved expenses or alternative income.

6. Arrival and Departure; House Rules; Special Regulations

  1. Check-in: from 4:00 p.m.   Check-out: until 12:00 p.m. Early check-in/late check-out requires prior approval and may incur additional costs.
  2. Minimum age: Check-in is only permitted for persons aged 18 or above. Minors may only check in when accompanied by a legal guardian.
  3. Pets: Pets are allowed. The Guest is fully liable for all damages or extra costs caused by their pet. Additional cleaning/wear may be charged.
  4. Smoking: Smoking is strictly prohibited inside the house and apartments. A cleaning fee of EUR 150 applies in case of violation. Further claims for damages remain reserved.
  5. Keys/Access: Loss of keys or access media must be reported immediately. Replacement and lock system costs may be charged.
  6. House rules: The house rules posted on-site or provided in the guest folder form part of the contract.

7. Video Surveillance in Public Areas

  1. Certain public areas (e.g. entrance, hallways, parking areas) may be subject to video surveillance for security reasons. Living/sleeping rooms and bathrooms are not monitored.
  2. Signs indicate monitored areas. Further details (purposes, legal basis, storage periods, data subject rights, controller contact) are provided in the Privacy Policy.

8. Liability

  1. The Host is liable under statutory provisions for damages arising from injury to life, body, or health if caused by the Host’s breach of duty.
  2. For other damages, the Host is liable only in cases of intent or gross negligence, or for breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typical damages.
  3. The Host is liable for items brought by the Guest within statutory limits. Use of any safes is at the Guest’s own risk.
  4. The Guest is solely liable for damages caused by pets.
  5. The Host assumes no liability for vehicles or items left in parking areas, unless caused by intent or gross negligence.

9. Data Protection

  1. The Host processes personal data of the Guest for contract initiation, execution, and settlement. Details, especially regarding the Guest’s rights, are set out in the Privacy Policy.

10. Final Provisions

  1. Amendments and supplements to the contract or these T&C must be made in text form. This also applies to any waiver of this text form requirement.
  2. If the Guest is a merchant or legal entity under public law, the place of jurisdiction – where legally permissible – is the Host’s registered office. German law applies; the UN Convention on Contracts for the International Sale of Goods does not apply.
  3. The European Online Dispute Resolution platform (ODR) is available at https://webgate.ec.europa.eu/odr. The Host is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
  4. If any provision of these T&C is or becomes invalid, the validity of the remaining provisions shall not be affected. The statutory provision shall apply instead of the invalid clause.
